Attention: Service Members Still at Risk under DADT
The bottom line is that Monday's ruling by the 9th Circuit Court of Appeals means "Don't Ask, Don't Tell" (DADT) is still in effect and service members should NOT come out. This "stay pending appeal" follows the 9th Circuit's "administrative stay" of the injunction issued last month by U.S. District Court Judge Virginia Phillips, which barred enforcement of DADT. Because DADT is still in effect, service members remain in danger of being investigated and discharged under this law. If you want to join you may still be barred from doing so if you were previously discharged under DADT or if you disclose your sexual orientation to a recruiter.
