Last month, a federal district court struck down the military's anti-gay "don't ask, don't tell" policy in response to a challenge brought by the Log Cabin Republicans, a grass roots Republican gay rights organization. Like the successful lawsuit challenging bans on same-sex marriage brought in part by former Bush Solicitor General Theodore Olson, this litigation disrupts the traditional association of Republicans with anti-gay positions and Democrats with pro-gay positions. While of course many Republicans have always been pro-gay, such high-profile cases may suggest a new role for Republicans as thought leaders in the movement for LGBT equality. This panel will use Log Cabin Republicans v. United States to explore the role that both Democrats and Republicans have played in formulating and dismantling the military's policy banning open service by lesbian, gay, and bisexual service members. Have progressive and conservative legal strategies to disestablish the policy been different? What about political strategies to convince undecided individuals in the nation at large? Is this a simple story of bi-partisan convergence, or are there enduring conflicts between the political parties regarding the ultimate goals of the gay-rights movement?
