On Wednesday, July 6, 2011, adding to the confusion caused by the inexplicable delay in certifying the repeal of Don’t Ask, Don’t Tell, the 9th Circuit Court of Appeals lifted the stay it had granted last year in the Log Cabin Republican case. This reinstates US District Judge Virginia Phillips’ judgment that DADT is unconstitutional, as well as the worldwide injunction against the Department of Defense. The injunction, which in effect renders DADT unenforceable, will remain in full force and effect pending the appellate court hearing now scheduled for the week of August 29, 2011.
